1. Description of Service

SmartRead is an audio learning platform that allows users to consume informational content in audio form. Features of the Service may include:

• Audio playback of books, articles, or other materials
• AI-generated summaries
• AI-powered question answering
• Voice-based interaction
• User-uploaded content

We may modify, suspend, or discontinue features of the Service at any time.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with parental or guardian consent.

3. Accounts

Some features require an account. You agree to:

• Provide accurate account information
• Maintain the confidentiality of your login credentials
• Notify us of unauthorized account use

You are responsible for all activity that occurs under your account.

4. User Content

The Service may allow users to upload or submit content (“User Content”), including documents, audio files, or other materials. You retain ownership of your User Content. By uploading User Content, you grant Windpeak Corporation a worldwide, non-exclusive, royalty-free license to:

• Process and analyze the content
• Generate summaries and audio
• Generate AI responses related to the content
• Provide and improve the Service

5. Responsibility for Uploaded Content

You represent and warrant that:

• You own the content you upload, or
• You have the legal right to use and process the content

You agree not to upload content that:

• Infringes copyright
• Violates intellectual property rights
• Violates applicable law

Windpeak Corporation does not verify ownership of uploaded content and is not responsible for user-provided materials.

6. Copyright Compliance

Windpeak Corporation respects intellectual property rights. If you believe content available through the Service infringes your copyright, you may submit a notice pursuant to the Digital Millennium Copyright Act (DMCA). We may remove allegedly infringing material and terminate repeat infringers.

7. AI-Generated Content

SmartRead uses artificial intelligence systems to generate summaries, answers, and other outputs. AI-generated outputs:

• May contain inaccuracies
• May be incomplete
• May not faithfully represent original source material

AI outputs are provided for informational purposes only. You are responsible for evaluating and verifying AI-generated content before relying on it.

8. AI Processing

User Content may be processed by AI systems in order to provide Service features. Unless explicitly stated otherwise, we do not use user-uploaded content to train general AI models.

9. Safe Use While Driving

SmartRead may be used while driving or during other activities. However:

• Users must obey all traffic laws
• Users must remain attentive while operating vehicles
• Users should rely on voice interaction rather than screen interaction

Do not interact with the Service while operating a vehicle unless it is safe to do so. Windpeak Corporation is not responsible for accidents, injuries, or damages resulting from the use of the Service while driving.

10. Intellectual Property

All software, algorithms, and content provided by the Service (excluding User Content) are owned by Windpeak Corporation or its licensors. You may not:

• Copy
• Reproduce
• Modify
• Distribute
• Reverse engineer
• Commercially exploit

any part of the Service without permission.

11. Acceptable Use

You agree not to:

• Upload illegal or infringing content
• Interfere with Service operations
• Attempt to gain unauthorized access
• Abuse AI features
• Scrape or extract Service data

We may suspend or terminate accounts that violate these Terms.

12. Subscription and Payments

Some features may require a paid subscription. Subscriptions may be billed through:

• Apple App Store
• Other payment providers

Subscriptions may automatically renew unless cancelled. Billing, cancellation, and refunds are handled by the payment provider.

13. Termination

We may suspend or terminate access to the Service if:

• You violate these Terms
• Your use creates risk to the Service or other users
• We discontinue the Service

You may stop using the Service at any time.

14. Disclaimer of Warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Windpeak Corporation disclaims all warranties, including:

• Fitness for a particular purpose
• Non-infringement

We do not guarantee uninterrupted or error-free operation.

15. Limitation of Liability

To the fullest extent permitted by law, Windpeak Corporation will not be liable for:

• Indirect damages
• Incidental damages
• Loss of profits
• Loss of data
• Damages arising from AI-generated outputs
• Damages related to user-uploaded content

16. Indemnification

You agree to indemnify and hold harmless Windpeak Corporation from any claims, damages, or liabilities arising from:

• Your use of the Service
• Your uploaded content
• Your violation of these Terms
• Infringement of third-party rights

17. Arbitration Agreement

Any dispute arising from these Terms or the Service will be resolved through binding arbitration, rather than court litigation. Arbitration will be conducted under the rules of the American Arbitration Association. You agree that disputes will be resolved on an individual basis and not as part of a class action.

18. Class Action Waiver

You agree that any claims must be brought individually and not as a plaintiff or class member in any class action or representative proceeding.

19. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
